Terms and Conditions of Sale and Use
OVERVIEW
Welcome to Kidora™.
The terms "we," "us," and "our" refer to Kidora™. Kidora™ operates this online store and website, along with the information, content, features, tools, products, and services offered on it (the "Services").
Our store is hosted on the Shopify platform, which enables us to provide our Services to you and process your orders.
These Terms and Conditions of Sale and Use, along with the policies referenced within them, define the rights and obligations applicable to use of the site and purchases made from Kidora™.
By using our site or placing an order, you acknowledge that you have read these Terms as well as our Privacy Policy.
These Terms do not in any way limit the mandatory rights granted to consumers under applicable French or European law.
ARTICLE 1 – SITE ACCESS AND CUSTOMER ACCOUNT
You must have the legal capacity required to make a purchase on our site.
If a customer account is offered, you are responsible for the accuracy of the information you provide as well as the confidentiality of your login credentials.
The information provided when placing an order, including your name, email address, billing address, and shipping address, must be accurate, complete, and up to date.
Kidora™ cannot be held liable for a delivery failure or delay resulting from incorrect information provided by the customer, subject to applicable legal provisions.
ARTICLE 2 – PRODUCTS
We make every effort to present the products offered in our store as accurately as possible.
However, the colors and appearance of a product may vary slightly depending on the screen, device, or settings used.
Photographs and illustrations are intended to represent the products as faithfully as possible.
The essential characteristics of each product are indicated on its product page.
Kidora™ may modify its catalog, remove a product, or limit available quantities, provided that such changes do not affect orders already confirmed.
Nothing in this article limits the rights available to consumers when a received product does not conform to its description or the contract.
ARTICLE 3 – ORDERS
When you place an order in our store, you agree to provide accurate and complete information.
Before confirming your order, you have the opportunity to review the selected products, their quantity, price, and your contact details.
An order is considered registered once payment has been validated and the order confirmed.
A confirmation email is sent to the address provided at the time of purchase.
Kidora™ reserves the right to refuse or cancel an order for a legitimate reason, including:
- suspected fraud;
- a manifest pricing error;
- exceptional unavailability of the product;
- an abnormally large order;
- a payment-related issue;
- clearly incorrect information.
If Kidora™ cancels an order, any amounts already collected for the cancelled products will be refunded.
If you wish to modify or cancel an order, please contact us as soon as possible at clubkidora@gmail.com.
We will do our best to accommodate your request. However, a modification or cancellation may no longer be possible if the order has already been prepared or shipped.
This provision does not affect your legal right of withdrawal where applicable.
Returns are governed by our Return and Refund Policy available on our site.
ARTICLE 4 – PRICE AND PAYMENT
Prices displayed in our store for consumers in France are expressed in euros (€) and shown inclusive of all taxes where required by regulation.
Any additional costs, including shipping fees where applicable, are indicated to the customer before final confirmation of their order.
The applicable price is the one displayed at the time the order is placed.
Kidora™ may change its prices, promotions, or offers at any time. Such changes do not, however, affect an order already confirmed.
Promotions may be subject to specific conditions indicated at the time of the offer.
Payment must be made using one of the payment methods available when placing the order.
You warrant that you are authorized to use the selected payment method.
If payment is declined by the bank or payment provider, the order may not be validated.
ARTICLE 5 – SHIPPING AND DELIVERY
Estimated preparation and delivery times are communicated on our site or when placing an order.
Stated timeframes may vary depending on the destination, carrier, time of year, or exceptional circumstances.
Kidora™ strives to meet the stated timeframes and remains responsible for its delivery obligations in accordance with applicable law.
In the event of a significant delay, the consumer has the rights provided under applicable law.
Where the carrier is arranged by Kidora™, the risk of loss or damage to the product transfers to the customer when they take physical possession of the product, or when a third party designated by them, other than the carrier, takes possession of it.
If a package is marked as delivered but you have not received it, or if a package appears to have been lost in transit, please contact us at clubkidora@gmail.com so we can look into the matter with the carrier.
ARTICLE 6 – RIGHT OF WITHDRAWAL AND RETURNS
Consumers covered by European distance-selling rules have a legal right of withdrawal of 14 days from receipt of the product, subject to exceptions provided by law.
Kidora™ also offers a commercial return policy that may extend this period up to 30 days after receipt, according to the conditions set out in our Return and Refund Policy.
In the case of a simple change of mind, direct return shipping costs are the customer's responsibility.
This rule does not apply to costs necessary to process a product recognized as defective or non-conforming, where the law requires the seller to bear them.

ARTICLE 7 – LEGAL WARRANTY OF CONFORMITY
Consumers benefit from the applicable legal warranties independently of any commercial policy offered by Kidora™.
Kidora™ is liable for defects in conformity of the product under the conditions provided by the French Consumer Code (Code de la consommation).
For eligible goods, the consumer has, in particular, a period of two years from delivery of the goods to bring a claim under the legal warranty of conformity.
In the event of a defect in conformity, the consumer may, under the conditions provided by law, obtain the product's conformity through repair or replacement.
Where these remedies are impossible, disproportionate, or cannot be implemented under the conditions provided by law, the consumer may, among other things, be entitled to a price reduction or termination of the contract.
The legal warranty of conformity is exercised at no cost to the consumer in situations covered by law.

ARTICLE 8 – WARRANTY AGAINST HIDDEN DEFECTS
The consumer also benefits from the legal warranty against hidden defects provided under the French Civil Code.
This warranty may apply where a hidden defect existing at the time of sale renders the product unfit for its intended use, or so significantly reduces that use that the customer would not have purchased it, or would have paid a lower price, had they been aware of it.
Under the conditions provided by law, the consumer may choose to return the product and obtain a refund of the price, or keep the product and obtain a price reduction.
A claim based on hidden defects must be brought within the legal time limit applicable, starting from the discovery of the defect.
ARTICLE 9 – INTELLECTUAL PROPERTY
The elements present on our site, including text, images, photographs, videos, illustrations, logos, trade names, graphics, designs, and content, are protected under applicable French, European, and international intellectual property rules.
Except with prior written authorization from Kidora™ or the relevant rights holder, it is prohibited to reproduce, copy, modify, distribute, sell, republish, or commercially exploit these elements.
Access to our site does not grant you any intellectual property rights over the content presented on it.
Trademarks and elements belonging to Shopify or other third parties remain the property of their respective owners.
ARTICLE 10 – THIRD-PARTY TOOLS AND SERVICES
Certain features of our store may be provided by third-party providers.
Use of these services may be subject to the terms and policies specific to those providers.
Kidora™ does not necessarily control all services provided directly by third parties and cannot be held liable for their actions when they act independently of Kidora™, subject to the responsibilities legally incumbent on us toward our customers.
ARTICLE 11 – LINKS TO THIRD-PARTY SITES
Our site may contain links providing access to sites operated by third parties.
Kidora™ does not necessarily exercise control over these sites and is not responsible for their content, practices, or privacy policies.
We recommend reviewing the applicable terms before using a service or completing a transaction on a third-party site.
ARTICLE 12 – RELATIONSHIP WITH SHOPIFY
Kidora™ uses Shopify to host and operate its online store.
Any sale made through our store is nonetheless concluded directly between the customer and Kidora™.
Shopify provides the technology infrastructure enabling the store to function but is not the seller of the products offered by Kidora™.
Certain data may be processed by Shopify in accordance with the conditions necessary to provide its services and its own privacy policy.
ARTICLE 13 – PROTECTION OF PERSONAL DATA
Personal data collected by Kidora™ is processed in accordance with our Privacy Policy available on our site.
This information may notably be necessary to:
- process orders;
- process payments;
- arrange deliveries;
- respond to customer service requests;
- prevent fraud;
- comply with our legal obligations.
Certain providers necessary for order fulfillment, including Shopify, payment providers, and carriers, may process certain data as part of their services.

ARTICLE 14 – REVIEWS, COMMENTS, AND USER-SUBMITTED CONTENT
When you voluntarily send us a review, photograph, video, suggestion, or any other content, you represent that you hold the rights necessary to send it to us.
You agree not to post or transmit content that is:
- illegal;
- defamatory;
- fraudulent;
- threatening;
- infringing on the rights of a third party;
- containing malicious software.
Subject to the rights applicable to your personal data and image, when you voluntarily send us content intended to be published or shared, you authorize us to use it in connection with the promotion and operation of Kidora™, unless you indicate otherwise or where your specific consent is legally required.
Kidora™ may remove content that is clearly unlawful or contrary to these Terms.
ARTICLE 15 – ERRORS AND INACCURACIES
Despite our best efforts, certain information on the site may occasionally contain an error or omission relating in particular to:
- a description;
- a price;
- a promotion;
- availability;
- a delivery time.
Kidora™ may correct such errors as soon as they are identified.
If an error substantially affects an order already placed, we will inform you and apply the rights provided under applicable law.
ARTICLE 16 – PROHIBITED USES
You agree not to use our site:
- for illegal or fraudulent purposes;
- to infringe the rights of Kidora™, Shopify, or a third party;
- to transmit malicious software;
- to fraudulently collect personal data;
- to disrupt the operation or security of the site;
- to impersonate another person;
- to attempt to gain unauthorized access to our systems;
- to carry out abusive automated operations likely to disrupt the operation of the site.
We may limit or suspend a user's access when reasonably necessary to protect the site, our users, or our rights.
ARTICLE 17 – SITE AVAILABILITY
We make every effort to ensure the availability and proper functioning of our store.
However, access to the site may occasionally be interrupted, in particular for:
- maintenance;
- updates;
- technical issues;
- an incident affecting a service provider;
- an event beyond our control.
A temporary interruption of the site does not affect rights already acquired under an existing order.
ARTICLE 18 – LIABILITY
Kidora™ is liable for the performance of its obligations in accordance with applicable legal provisions.
Nothing in these Terms is intended to exclude or limit any right or liability that cannot legally be excluded or limited, including rights arising from:
- the legal warranty of conformity;
- the warranty against hidden defects;
- the right of withdrawal;
- mandatory consumer protection rules.
Kidora™ cannot, however, be held liable for damage resulting directly from improper use of the product contrary to the instructions provided, subject to the application of mandatory legal rules.
In the event of force majeure or an external event meeting the conditions provided under applicable law, the affected obligations may be suspended for the duration of the event.
ARTICLE 19 – FORCE MAJEURE
Kidora™ cannot be held liable for a delay or failure to perform resulting from an event constituting force majeure within the meaning of applicable law.
Where possible, we will inform the customer of such an event substantially affecting the fulfillment of their order.
The consumer's rights under mandatory provisions remain applicable.
ARTICLE 20 – SEVERABILITY
If any provision of these Terms is found to be void, illegal, or unenforceable, the remaining provisions will continue to have effect to the extent the contract can survive without the provision concerned.
ARTICLE 21 – ENTIRE AGREEMENT
These Terms, our Privacy Policy, our Shipping Policy, and our Return and Refund Policy constitute the main rules applicable to the use of our store and to orders placed with Kidora™.
In the event of doubt regarding the interpretation of a clause offered to a consumer, the legal rules applicable to consumer protection remain applicable.
ARTICLE 22 – CHANGES TO THE TERMS
Kidora™ may amend these Terms in order, in particular, to take into account:
- developments in our Services;
- a legislative or regulatory change;
- a technical development;
- a change in our business practices.
The version applicable to an order is the version in effect at the time that order is placed, unless otherwise required by law.

ARTICLE 23 – GOVERNING LAW
These Terms are governed by the law applicable to Kidora™, subject to mandatory provisions protecting consumers.
Where a consumer resides in a European Union country, nothing in these Terms may have the effect of depriving them of the mandatory protections afforded by the law applicable in their country of residence, where such protections must legally apply.
The competent courts are determined in accordance with applicable legal rules.
ARTICLE 24 – COMPLAINTS AND CONSUMER MEDIATION

We will make every effort to find an amicable solution.
In accordance with applicable provisions on consumer mediation, a consumer may, after having first sent a written complaint to Kidora™ and in the absence of a satisfactory resolution, make free use of the consumer mediator to which Kidora™ is affiliated.
